Terms and Conditions:

1. Scope
All deliveries are carried out on the following terms. Divergent agreements require the written form.

2. Prices
Basis is the current price list. The prices are valid per meter or piece net before value added tax. Prices change at raw materials, wage costs, customs, improved purchase prices etc. Only the prices declared in our order confirmations are therefore obligatory. Freight and packing costs are calculated in addition.

For small orders with an order value below € 50,- (net) we add a surcharge of € 6,50 per order.
Delivery ex works Götzis/Austria.

3. Measures and weights
Measure and indications of weight are carried out subject to an insignificant, technically conditional deviation.

4. Orders
The order acceptance is made exclusively by our written order confirmation. Verbal arrangements are non-committal.

5. Delivery times, partial delivery
Delivery date or delivery periods are valid according to the order confirmations. They are adhered if the product leaves our work to the day agreed on or to the day of the period sequence of operations. The delivery period starts with the date of the order confirmation. We are also authorized to partial delivery in a reasonable scale. Compensation for delays in shipment are excluded. This applies particularly to unforeseen malfunctions, troubles of the carriage ways, lack of production material and energy, strikes and lock outs.

6. Transportation risk
All deliveries are carried out on the risk of the buyer as soon as the product is submitted to the forwarding agent, the carrier or a person intended for the execution of the consignment or institution. This is also valid if the product is sent with our company vehicle.

7. Defects, guarantee
Obvious defects must be claimed at receipt of the product. Guarantee and damage compensation entitlements because of defects are excluded after 6 months. In the two cases the reprimand has to be in written form. Defectivness of a section doesn‘t entitle to the complaint about the complete delivery. Unsatisfactory goods are replaced at return or will be repaired. Only after failing twice repeatedly the improvement and impossibility of the substitute delivery the customer is authorized to require reduction of the price or annul the contract.

8. Terms of payment
The invoice amounts are payable within 30 days after date of invoice. For payment within 8 days as of date of invoice a cash discount of 2% is granted. Expenses are calculated at delay in payment. Interest on late payment: Discount rate plus 3%.
Delivery to new clients only against prepayment.

9. Reservation of title
The delivered product remains our property till all our claims are satisfied against the buyer as far as they are in connection with the delivered product.

10. Applicable Law and Venue
Exclusively Austrian Law Court in Feldkirch, Austria. Austrian law is applicable.
